By downloading, installing, or using the Thoccy macOS application (the "Software") or accessing the Thoccy website (the "Site"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not download, install, or use the Software or Site.

2. License Grant

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Software on a single macOS device that you own or control, solely for your personal or internal business use. You may not distribute, lease, sell, or rent the Software to any third party.

3. Open Source & Third-Party Components

Thoccy simulates mechanical keyboard sounds using various open-source assets and software components. The sound packs bundled with Thoccy include sounds from the open-source **Mechvibes** project, and the Software utilizes the **OggDecoder** library, both of which are distributed under the **MIT License**.

Full license texts for all open source components are included with the Software distribution. The use of these components does not imply endorsement by their respective authors.

4. Purchases, Payments & Refunds

Thoccy is offered as a one-time purchase. All payments are processed securely via Stripe. We offer a **30-day money-back guarantee** if you are not satisfied with your purchase. To request a refund, please contact us at [email protected] within 30 days of purchase with your transaction details.

5. Restrictions & User Conduct

You agree not to reverse engineer, decompile, or disassemble the binary components of the Software. You may not use the Software for any illegal or unauthorized purpose.

THE SOFTWARE AND SITE ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL OPERATE UNINTERRUPTED OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THOCCY OR ITS CREATORS BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR INDIRECT DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, OR LOSS OF DATA, ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE.

8. Governing Law & Jurisdiction

These Terms of Service and any dispute arising out of your use of the Software or Site shall be governed by, and construed in accordance with, the laws of the **State of California**, United States, without regard to conflict of law principles. Any legal action related to these terms shall be filed in the state or federal courts located in San Francisco, California.

9. Trademark & Brand Disclaimer

All product names, logos, brands, and registered trademarks (including "Cherry MX", "Topre", and others) referenced on the Site and within the Software are the property of their respective owners.

The use of these names, trademarks, and brands is for identification and descriptive purposes only, representing the specific keyboard switches simulated by the Software. Thoccy is an independent software application and is not affiliated with, sponsored by, authorized by, or endorsed by Cherry GmbH, Topre Corporation, or any other trademark owners.
